SAW Video Facility Equipment Rental Contract
(Please read the following Policy. If you have any questions regarding any part of the policy please ask before signing the agreement.)
SAW Video's facilities are primarily for the use of individuals in the production of their own work. The facilities are also available to non-profit groups and cultural organizations.
(The term member, as used in this contract, refers to any person that said equipment is rented to, leased to, or loaned to. )
MEMBERSHIP
SAW Video has only one membership category: individual membership. Individual membership is open to all individuals whose primary utilization of SAW Video is for the purpose of producing their work; that is, they own copyright in whole or in part. While working on their own projects individual members are entitled to individual equipment rental rates (listed on rate sheet).
Anyone utilizing SAW Video's equipment, must either: a) satisfy the Technical Co-ordinator (or an appointed representative of SAW Video) that he/she can completely and safely operate the equipment; or b) take the necessary workshops to obtain accreditation in the use of said equipment.
The following conditions apply to members renting equipment from SAW Video:
a) Who have no outstanding debts to SAW video;
b) Have demonstrated knowledge of the equipment or has satisfactorily completed training conducted by an appointee of SAW video.
The member agrees to report any theft or mysterious disappearance of equipment borrowed from SAW video to the police IMMEDIATELY. The member also agrees to report promptly any damage and/or theft and/or disappearance of equipment as well as the circumstances under which either occurred to the Technical Co-ordinator and/or the Administrative Co-ordinator. Failure to do so will result in the member assuming liability for the total cost of replacing or repairing any equipment that is lost, stolen, or damaged while in his\her possession.
Further, the member bears responsibility for either the total cost of loss and damage (when not covered by insurance, or the insurance deductible of $1,500.00 in instances when insurance covers the damage or loss.
All members who return equipment without declaring damages incurred during the period in which the equipment was in their possession will be liable for the cost of repairs and may be subject to expulsion from the Video Co-op. In the case of such action the member has the right to appeal such a decision to the Board of Directors of SAW.
- No member will attempt any repairs or modifications to the equipment or suite facilities without the consent of access co-ordinator (ex. re-configuration of cables).
- All equipment must be restored to clean and orderly condition after each use.
- Saw Video requests that credit for use of facilities and/or equipment appear in the titles of the production (or, where credits are inappropriate, SAW Video will be acknowledged in written material accompanying the tape): "Produced through the facilities of SAW Video Co-Op.
- Organizations and groups must appoint one individual who will act as the liaison between the group and SAW Video; this person accepts full responsibility for the equipment.
- SAW Video accepts no liability for injury or accident while the facilities or equipment are in use.
- Personal Injury, such as invasion of privacy, liable, slander, is not included under SAW Video's Liability coverage, and is not therefore covered by our equipment rental insurance policy. Members are encouraged to take out their own insurance policy, and members, including those who already have their own certificate of insurance, should name SAW Video as an additional insurer on their policy.
- The member accepts all of the above conditions. Failure to comply may result in suspension.
BOOKINGS
- The annual insurance premium must be paid before use of equipment will be permitted.
- New users will be required to pay upon usage for all bookings until their credit-worthiness is established. A service charge will be applied monthly to all overdue accounts (30 days).
- Booking may be made by phone or in person. At the time of booking, members must provide a short description of the work they intend to pursue, or fill out the Website on line production form. The SAW Video Co-ordinator (or an appointed representative) will review the description/proposal and inform the member as to the applicability of the production at SAW. If the proposed video tape fits into the category of "video-art", it is encouraged that the finished product be submitted for consideration in SAW Gallery Video's members quarterly screenings.
- Forty-eight (48) hours notice (two full business days) must be given for cancellation. Full booking charges will be incurred if there is less than 48 hours notice.
- Before receiving equipment or gaining access to facilities, all members must fill out a booking form and sign it. Use of the facilities or equipment will not be granted unless this is done.
- Though the Video Co-ordinator and any other employees of SAW Video are actively involved in maintaining the equipment, it is recommended that members check the equipment before taking it out.
- In the event of genuine equipment failure (i.e. if it can be demonstrated that it was not the result of the operator's error), credit will be made to the member amounting to the time lost. Any equipment malfunction should be reported to the Co-ordinator and a damage report filed before a credit will be established.
- Equipment must be returned at the time noted on the booking form. A fine will be charged for late returns, in addition to a charge amounting to the total hourly equipment rate.
- Members in good standing are eligible to apply for a credit limit of up to $250.00 after two equipment rentals, This can be extended to $500.00 at the discretion of the staff. At $500.00 in overdue member's account, or if an payment on an account is overdue 60 days, access to equipment will be denied unless it is extended at the discretion of the management committee. Overdue bills in excess of 90 days will go to collection if a payment plan cannot be devised. Members with a poor record of payments will be restored credit on the discretion of the management.
